Article 1 - Purpose
These Terms of Use ("Terms") define how the Hestoria service, available at hestoria.app, may be used.
Hestoria is a service for creating personalized photo books: the user uploads photos, provides context, and a unique story is generated by artificial intelligence and then laid out into a printable PDF.
Any use of the service constitutes full and unreserved acceptance of these Terms.
Article 2 - Access to the service
The service is available to any adult natural person. Registration is free. Generating the photo book is a paid service and is billed via LemonSqueezy, a secure payment processor.
The user may access the service as a guest (without an account) or after creating an account (email/password or Google OAuth). An account makes it possible to find your stories again in "My stories".
Hestoria reserves the right to suspend access to the service for maintenance or in the event of a breach of these Terms.
Article 3 - Price and payment
The applicable price is clearly displayed before the order is confirmed. The launch price per photo book is €14.99 incl. tax for the Family, Couple and Wedding themes, and €12.99 incl. tax for the Baby, Children, Travel, Birthday and Friendship themes.
All prices are stated in euros, inclusive of all taxes. Payment is securely processed by LemonSqueezy (bank card). Hestoria does not store any banking data. The amount actually charged is always the one displayed on the payment page at the time of the order.
The order is final once payment is confirmed. An e-mail containing the PDF download link is sent to the address provided at payment.
Article 4 - Refund policy
In accordance with Article L.221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to digital content whose supply has begun with the consumer's express consent (the PDF is generated and delivered immediately after payment).
However, in the event of a proven technical malfunction preventing the generation or receipt of the PDF, Hestoria undertakes to offer either a new generation or a full refund processed via LemonSqueezy.
For any refund request: [email protected].
Article 5 - User obligations
The user undertakes to:
- Only upload photos to which they hold the rights or for which they have the consent of the people depicted;
- Not upload unlawful, pornographic or violent content, or content that undermines human dignity;
- Obtain the consent of legal guardians before uploading photos of minors;
- Not use the service for commercial resale purposes without prior written agreement;
- Not attempt to circumvent security measures or to access other users' data.
Hestoria reserves the right to immediately suspend any account in the event of a breach of these obligations, without refund.
Article 6 - Intellectual property
User photos: The user retains all rights to the uploaded photos. By using the service, they grant Hestoria a temporary, non-exclusive and non-transferable license, limited to the processing needed to generate and edit the photo book. Photos are automatically deleted along with the associated story, no later than 30 days after its creation.
Generated photo book: The generated PDF belongs to the user. Hestoria claims no rights over the personalized content produced.
Service and technology: The interface, templates, algorithms, AI models and all the components of the service remain the exclusive property of Hestoria and are protected by French and international intellectual property law.
Article 7 - Personal data
Hestoria processes personal data in accordance with the GDPR. Uploaded photos and the photo book (PDF) are automatically deleted no later than 30 days after the story is created. We encourage you to keep the PDF received by e-mail.
The user may delete their account and all their data at any time from the My account page. For more information, please see our Privacy Policy.
Article 8 - Limitation of liability
The service is provided "as is". Stories generated by AI are automatic and may contain inaccuracies. The user is invited to review the content before any use. Hestoria cannot be held liable for any direct or indirect damage resulting from use of the service.
Hestoria does not guarantee permanent availability of the service (maintenance, technical incidents) and cannot be held responsible for any temporary unavailability.
Article 9 - Amendment of the Terms
Hestoria reserves the right to amend these Terms. Any amendment will be published on this page. Continued use of the service after amendment constitutes acceptance of the new Terms.
Article 10 - Consumer mediation
In accordance with Articles L.612-1 et seq. of the French Consumer Code, the consumer has the right to make free use of a consumer mediator with a view to the amicable resolution of a dispute with Hestoria, after having first attempted to resolve it through a written complaint made directly to us.
The consumer mediator to which Hestoria is affiliated is : [TO BE COMPLETED: name of the mediator, postal address and website]. (Hestoria must join an approved consumer mediation service — e.g. CM2C, Medicys, SAS Médiation Solution — and report its details here.)
Article 11 - Applicable law and disputes
These Terms are governed by French law. In the event of a dispute, an amicable solution (direct complaint then mediation, see Article 10) will be sought as a priority. Failing agreement, the competent French courts will be seized under ordinary law.
